TSMC has admitted in an annual income report that cannot control where the chips it produces will stop after they are sent to customers. The company comments on the case in which it faces US billionaire fine after its components were found in Huawei accelerators using China restricted shipping technologies.

“Our role in the semiconductor supply chain inherently limits our visibility and information available to us about the use or user of the end products that incorporate semiconductors manufactured by us,” says the TSMC document. “This limitation prevents our ability to completely ensure that semiconductors manufactured by us will not be diverged for use or unintentional users, including potentially by our business partners or third parties with an intention to deceive.”

According to Tom’s hardware information, TSMC works with contracts that depend on a GDS file, which offers all the details needed to make a chip. But this information does not need to include the chip developer or its final destination. This way, the company cannot guarantee that it will not have to face US regulatory agencies again.

Can TSMC face more fines?

The US government investigates TSMC after its chips were found in Huawei’s Ascend 910b and 910C accelerators, who got the components through an outsourced Sophgo. The Taiwanese manufacturer’s speech in his official document does not rule out the possibility of something like that happens again.

It is difficult now to speculate which TSMC plan not to lose billions in fines and avoid even more drastic punishments in the future.
