TSMC is facing a lawsuit filed in August this year that accuses the company of race and citizenship discrimination at its facilities in Arizona, United States. Company employees accuse their bosses of favoring people of Asian origin or Taiwanese citizenship in work relationships.
The lawsuit was filed in the name of Deborah Howington, who worked directly as a director of talent acquisition for TSMC in August. Howington states that he witnessed the HR department create an environment in which non-Asian or non-Taiwanese workers face “a stricter level of scrutiny.”
In court filings, attorneys for Howington and other plaintiffs mention the subsidy money TSMC will receive from Chips ACT:
“Having accepted $6 billion in funding from the U.S. government and choosing to compete within the U.S., it is imperative that TSMC comply with federal discrimination laws and treat all races, national origins and citizenships equally. We are confident in our case and look forward to presenting it to the jury.”
The accusations in the lawsuit also mention that TSMC in Arizona would be receiving resumes chosen by the company’s HR team in Taiwan and hiring these people without question. This would even happen in cases where there were no open positions at US facilities.
TSMC says it “believes in the value of a diverse workforce”
Contacted for comment, TSMC declined to speak directly about the lawsuit, but issued a statement related to the matter.
“TSMC believes strongly in the value of a diverse workforce, and we hire and promote without regard to gender, religion, race, national origin or political affiliation because we respect differences, and we believe that equal employment opportunities strengthen our competitiveness.”

Since the Taiwanese company began expanding its presence in Arizona, it has faced difficulties and friction in working relationships between its employees of different nationalities. Still, it appears that its facilities in the US are advancing in their production capacity, but the process should not help the company’s image there.
