The billionaire Elon Musk came in with a new lawsuit against OpenAI last Friday (29), in a United States federal court. The action seeks to prevent the startup from continuing to operate as a for-profit company, claiming that this undermines the organization’s original purpose. Musk also accuses the developer of ChatGPT of anti-competitive practices and violations of antitrust rules.

Change in business model

According to Musk’s lawyers, OpenAI abandoned its initial mission to develop artificial intelligence in an open and accessible way for everyone. The transition to a profit-focused business model would have changed the plans originally laid out by the founders.

It is worth remembering that Musk was one of the co-founders of OpenAI, but left the company’s board of directors in 2018. According to the new action, the startup would be discouraging investors from investing money in other AI companies. One of the financiers even gave up investing in xAI, Musk’s new AI company, due to this supposed persuasion.

Accusations against Microsoft and antitrust violations

The lawsuit also includes allegations that OpenAI was obtaining privileged information through its partnership with Microsoft, one of its main investors. This would violate antitrust rules, according to the complaint.

Another request highlighted in the action is that OpenAI make its AI model open source, as originally envisioned. The process also has Shivon Zilis, an executive at Neuralink, as a co-author.

Elon Musk has also made it clear that, in his view, OpenAI’s rapprochement with Microsoft undermined the company’s original mission of creating open source technologies that were not at the service of a business modeled after the company founded by Bill Gates and Paul Allen.

In a memo leaked in March, OpenAI’s chief strategy officer, Jason Kwon, stated that Musk’s stance proves that he is regretting not being more involved with the company.

In addition to OpenAI, other names were mentioned in the action, such as Greg Brockman, one of the startup’s co-founders; LinkedIn board member Reid Hoffman; and Microsoft executive Dee Templeton.

In a note sent to EngadgetOpenAI countered the accusations and criticized Musk’s history of filing repetitive complaints. “Elon’s fourth attempt, which again recycles the same baseless claims, remains completely without merit,” said the startup’s spokesperson
